Copyright Policy

This policy is effective as of 1 January 2009.

The tourlegends website (the "Site") and its content, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the "Website Content"), are the proprietary property of Orange Orbit Pte Ltd - © 2008-2009 ("The Company/We/Us/Our/tourlegends"), its users (see User Content below) or its licensees with all rights reserved.

No Website Content may be downloaded, republished, distributed, used to prepare derivative works, scraped, sold in any form or by any means, transmitted, or otherwise used except as explicitly permitted herein or without the Company's prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the Site.

You warrant that your own User Content infringes no laws as to copyright or in relation to any form of intellectual property, or is in any way contrary to public morality nor contains any defamatory material. You further warrant that all necessary consents have been obtained and will furnish these if requested. You will make good in full to us any damages, costs of expenses to which we may become liable in the event of any breach by you of this undertaking.

Tourlegends does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "User Content") that you post on or through the Site. Provided that you are eligible for use of the Site, after posting your Content to tourlegends, you continue to retain any such rights that you may have in your Content, subject to the limited license herein. By displaying or publishing ("posting") any Content on or through the Site, you hereby grant to the Company a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Content solely on or through the Site, including without limitation distributing part or all of the Website Content in any media formats and through any media channels, except Content marked "private" will not be distributed outside the Site. This limited license does not grant the Company the right to sell or otherwise distribute your User Content outside of tourlegends. After you remove your User Content from the Website we will cease distribution as soon as practicable, and at such time when distribution ceases, the license will terminate.

Except for your own User Content, you may not upload or republish Website Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Such license is subject to the Terms of Use and does not permit use of any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the Site or the Website Content other than as specifically authorized herein, without the prior written permission of Company, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.

We respect the intellectual property rights of others and we prohibit users from uploading, posting or otherwise transmitting on the tourlegends website or service any materials that violate another party's intellectual property rights. When we receive proper Notification of Alleged Copyright Infringement as described in our tourlegends Copyright Policy, we promptly remove or disable access to the allegedly infringing material.

If you believe that any material on the Site infringes upon any copyright which you own or control, you may send a written notification of such infringement to . Such written statement must include the following;

(i)statement that you have identified material on the tourlegends Site which infringes your copyright (or infringes the copyright of a third party on whose behalf you are entitled to act, if applicable);

(ii)a description of the copyrighted work that you claim has been infringed, which should include the type of work (such as a book or a sound recording) and any relevant further details (such as the title and date of publication, as applicable);

(iii)the country or countries to which your copyright applies;

(iv)a description of the way in which the copyright material has been infringed; (v) a description of where the material that you claim is infringing is located on tourlegends (including a URL and/or screen shot);

(vi)your address, telephone number, and email address so that we may get in contact with you;

(vii)the contact details that you would like us to provide to the alleged infringer so that they may contact you directly, in order to attempt to resolve the complaint;

(viii)a statement by you that you have a good faith belief that the disputed use of the copyright work is not authorized by the copyright owner (or by a third party who is legally entitled to do so on behalf of the copyright owner) and is not otherwise permitted by law;

(ix)a statement by you, made in the form of a statutory affidavit that the above information in the Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf and

(x)an electronic or physical signature (which may be a scanned copy) of the copyright owner. You shall also provide such other information as we might reasonably require.

If you believe your own copyrighted material has been removed from our website and/or service as a result of mistake or misidentification, you may submit a written Counter Notification to . Such written statement must include the following;

(i)statement that you have a good faith belief that the material in question was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;

(ii)Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled;

(iii)Your name, address and telephone number.

((iv)An electronic or physical signature (which may be a scanned copy) of the copyright owner. You shall also provide such other information as we might reasonably require.

If you send us a valid, written Counter Notification meeting the requirements described above, we will investigate your counter claim and may at our sole discretion, but are not obligated to, reinstate removed or disabled material unless we have received notice from the party filing the original Notification of Alleged Copyright Infringement informing us that such party has filed a court action to restrain you from engaging in infringing activity related to the material in question.

Tourlegends has adopted a policy of terminating, in appropriate circumstances and at the Company's sole discretion, members who are deemed to be repeat copyright infringers or who otherwise offend against any of the provisions stated herein. The Company may also at its sole discretion limit access to the Site and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement and whether or not such others or any third party has complained to us.
